Terms and conditions of Daily Cleaning Services - October 2011

Summary:

Daily Cleaning Services reserves the right to make changes to any part of these Terms and Conditions without notice.

These terms supersede any other issued by Daily Cleaning Services.

 

Nothing in these terms and conditions are intended to limit a consumer's existing legal rights.

By ordering Daily Cleaning Services service by telephone, e-mail, fax or via this website the client agrees to be bound by these terms and conditions.

It is accepted by the client that they have read & understood these terms & conditions in full, and that all services offered are done so on the basis of reasonable endeavour.

These terms and conditions shall be governed by the relevant United Kingdom law and by agreeing to be bound by them the customer agrees to submit to the exclusive jurisdiction of the relevant courts of the United Kingdom.

 

Daily Cleaning Services is insured for public liability and treatments risk.

General

All fragile and or breakable items should be secured, or removed from the area to be cleaned by the client before commencement of operations.

Equipment

Daily Cleaning Services will provide all cleaning materials and equipment to perform the work as specified by the client. The client agrees to supply all water and power for the works to be carried out.

Upholstery Cleaning

Furnishings should be cleaned frequently so to comply with the generally accepted industry standard practice.
This means that there are times when furnishings can be cleaned in accordance with generally accepted industry standards with due diligence and care rendering a satisfactory outcome. However the appearance of such furnishings can be negatively affected because:
Many unknown, and various, conditions involved and associated with, the blends of fibres used to construct such coverings, depth and degree of soiling, external or internal environmental conditions that may exist, and or prevail.

Daily Cleaning Services cannot be held responsible for the following:

- ageing or deterioration of fabric
- migrating marks from the back of fabrics to the front of said
- migration of unstable dyes
- deteriorated foam cushions
- restoration of white fabrics
- non removal of staining due to urine or faeces contamination
- finish or glaze loss
- frayed piping or welting
- broken or dysfunctional zips
- breakdown of fabric backing
- shrinkage
- removal of stains rendered permanent
- browning
- fading
- water marking
- yellowing
- hidden stains
- pre-existing wear and tear
- loose or broken frames and or legs
- loose or missing buttons
- loose buttons that become detached during cleaning process

Stable and Unstable Dyes

Loss of, and or change of colour, or bleeding of colours, should not occur during professional cleaning as long as the appropriate cleaning technique is used.
Testing and inspection procedures will identify fabrics which could develop problems with regard to the above.
If such test procedures indicate a potential for; loss of, and or change of colour, or bleeding of colours, Daily Cleaning Services will inform the Client of potential problem and only proceed with cleaning at the express wish of the Client. By giving permission, the Client releases Daily Cleaning Services of all risk associated.
Any additional risks or limitations will be discussed for your approval prior to any work commencing and by agreeing to such work Daily Cleaning Services will not be responsible for any damage caused.

Carpet Cleaning

 

Spillages and Staining

It may not be possible to remove certain spillage marks or spots from your carpet. If your carpet has become stained by a spillage, we accept no responsibility if a limited result is achieved. If spillages have been previously treated we accept no responsibility for any colour change which may occur due to cleaning.

Edges and Seams

All carpet edgings and seams should be correctly fitted and secured. It is the client's responsibility to ensure this is the case prior to cleaning. If any edgings or seams are not secure, Daily Cleaning Services will not accept any responsibility for: shrinkage, loose fibres and or, yarns becoming entangled with machinery and subsequently detached.
If such an occurrence should happen and damage is caused to the machine that Daily Cleaning Services is using to carry out the task, the Client will be fully liable for the full cost of repair or replacement, and the subsequent hire cost of replacement items of equipment. If due to the, deterioration and subsequent failure of, carpet backing, adhesive compounds or tapes, or any other method, such as stitching, employed to fasten edges and seams. Daily Cleaning Services accepts no responsibility for any movement of seems or edges.

Shrinkage

Shrinkage can occur when carpets are steam cleaned or shampooed. Daily Cleaning Services accepts no responsibility for any shrinkage.Daily Cleaning Services will undertake to avoid any shrinkage by identifying susceptible fabrics or fibres. Shrinkage can occur due to poorly fitted, repaired carpets, seams or edgings. Daily Cleaning Services will not be responsible for any such movement or shrinkage. Fabric deterioration, oxidized colours, fibres coated with: waxy, greasy, or unknown soil types may portray a false view and give an inaccurate expectation of satisfactory outcome. The said outcome may not become apparent until after cleaning. The following examples should be taken into consideration.
- colour loss due to the exposure to ultra violet rays
- fabric splitting, fraying and loose and or worn fibres
Daily Cleaning Services will not be held responsible for these conditions should it become apparent.

Carpet Protective Treatment

Any and all protective treatments applied to carpets or items fo upholstery by Daily Cleaning Services is done so in full compliance with the manufacturer's instructions. Such products are not designed to give 100% protection, but simply to assist repelling moisture for a reasonable period of time.
All protective treatments will wear off and lose their effectiveness, subject to the amount of traffic endured by it. The more traffic a carpet, or item of upholstery sustains, is directly proportional to the reasonable time period of its effectiveness becoming diminished.

Traffic, is defined in this paragraph as, footfall and or general movement across the surface of carpeted area by various objects not identified in this document.
Daily Cleaning Services do not guarantee that protective treatments, when applied, will stop any liquid from penetrating fibres. Protective treatment or treatments will, only be applied with the consent of the client knowing this fact.
This must be taken into consideration when requesting the appliance of this form of protective treatment. Daily Cleaning Services will not accept any responsibility for the product or its limitations.

Payment

Payment is due immediately after works have been completed either by cheque or cash. If the bank refuse to honour a cheque for any reason, we will issue a £35 debt recovery charge, and employ all reasonable means to recover the debt in full. If we have to make a personal visit to recover such debt a further charge of £35 plus mileage charge of £1 per mile both ways will be added to the debt. If subsequent visits are required the same charges will apply.
For commercial clients with an authorised credit account 21 day terms are applicable. Commercial clients, failure to pay on time will result in a late payment surcharge of 10% of original invoiced price.
All and any costs incurred by the company in the pursuit of late payment will be added to the outstanding amount owed.
We charge a minimum of £45 for any cleaning task per visit.

Force Majeure

Neither party to this agreement shall be liable for failing to perform or delay of performance, if delay is caused by circumstances or events outside their reasonable control, which shall include but not be limited to: industrial action, acts of God, terrorism, civil commotion, and refusals to grant licences or permissions, and any unforeseen occurrences that prevail on the day.


Daily Cleaning Services, accepts no responsible for the falure to perform if:

  • we are not granted access, and free use of power and water.
  • third party intervention, pets included, entering or being present at the client's premises, during the cleaning process.
  • denial of access due to the client not present at the appointed time.*
  • wear or discolouring of fabric or fibres becoming visible once soiling has been removed.
  • failing to remove old stains.
  • if the cleaning process re-activates odours from old spills or stains.

The time for performance shall be extended for a reasonable time, having regard for the cause of the delay upon reasonable notice from the other party.

* We reserve the right to charge the client for time wasted, if the client has not given reasonable notice to us regarding their non attendance.

Complaints

We require to be notified in writing of any complaint within 7 days after completion of the cleaning work. No claims will be accepted after this time.
If the Client is dissatisfied with the work, we must be allowed to return and re-do the task at no extra charge to the client.
